               Supreme Court dismisses challenge to J&K delimitation

The Supreme Court, on Monday, dismissed a petition which challenged the delimitation exercise carried out for redrawing the Legislative Assembly and Lok Sabha constituencies in the Union Territory of Jammu & Kashmir

A Bench comprising Justice S.K. Kaul and Justice A.S. Oka passed the order in a plea, inter alia, challenging the delimitation exercise undertaken in the Union Territory of Jammu and Kashmir pursuant to the recent notifications.

Justice Oka, reading out the operative portion of the judgment, said that the judgment has clarified that the dismissal of the petition should not be construed as giving imprimatur to the decisions taken in relation to Article 370 as the said issue is pending before a Constitution Bench, full copy of the judgment is yet to be uploaded.

Senior Advocate, Mr. Ravi Shankar Jandhyala, representing the petitioners had contended that the delimitation exercise was in violation of the scheme of the Constitution of India, especially Article 170(3), which had frozen delimitation till the first census after 2026.

He had argued that the delimitation exercise was being carried out in the teeth of constitutional and statutory provisions.

He had further submitted that after the delimitation order was passed in the year 2008, no further delimitation exercise could have been undertaken. The Senior Counsel had emphasised that post 2008, all delimitation related exercise can be carried out only by the Election Commission and not a Delimitation Commission.

Justice Oka had highlighted that though the Senior Counsel for the petitioner had orally argued that the provisions of the Jammu And Kashmir Reorganisation Act, 2019 is in the teeth of the Constitution of India, the constitutional validity of the concerned provisions of the statute has not been challenged in the petition.

While opening his counter arguments, the Solicitor General of India, Mr Tushar Mehta also submitted at the threshold that the constitutionality of the provisions of the Reorganisation Act have not been challenged in the present writ petition.

The Solicitor General had controverted the petitioner’s argument that the provision of the 2019 Reorganisation Act was not consistent with each other or the constitutional framework.

It had been argued that the legislature intended the first delimitation to be undertaken by a Delimitation Commission and not the Election Commission, which is busy holding elections throughout the country.

Mr. Mehta reverted to the submission of the petitioner that Jammu and Kashmir was singled out for the delimitation exercise, as is evident from the second notification whereby the Central Government had removed delimitation for the States of Assam, Arunachal Pradesh, Manipur and Nagaland.

Mr. Jhandyala had argued that the same was violative of Article 14 of the Constitution. Mr. Mehta stated that there were internal disturbances in north eastern States and thus they were omitted from the notification.

The Counsel for Election Commission submitted that so far as the increase in number of seats is concerned, ample opportunity was given for raising objections, which was not utililsed and the delimitation order has now attained the force of law.

In his rejoinder, Mr. Jandhyala had pointed out that when a Member of the Parliament (MP) had raised a question on the floor of the Lok Sabha asking when will the seats in Andhra Pradesh be increased in terms of the AP Reorganisation Act, the Union Government’s response was that till 2026 it could not be altered in view of Article 170(3) of the Constitution.

He also emphasised that the J&K High Court as well as the Apex Court in 2011, had upheld the freeze on delimitation in J&K till 2026.

It had been also highlighted that, after the delimitation order of 2008, the Election Commission was entrusted with further exercises pertaining to delimitation. He had averred that the Election Commission had abdicated its duties.

The petition filed through Advocate on Record Sriram Parakeet asserted that the impugned Delimitation notification, which directed the process of delimitation to be carried out in UT of J&K to be done on the basis of the 2011 population census, is unconstitutional as no population census operation was carried out in 2011 for UT of J&K.

The petition also argued that the Delimitation Commission does not have the power to carry out the exercise as under Section 9(1)(b) of the Representation of Peoples Act, 1950 and Section 11(1)(b) of the Delimitation Act 2022, the power vested on the Election Commission is to update the Delimitation order by making the necessary changes on account of subsequent events and the said power cannot change boundaries or areas or extent of any constituency by way of any notification.

It argued that the Delimitation Commission cannot be established under Section 3 of the Delimitation Act 2002 as it has become inappropriate in 2007 when the Commission was wound up and after which the Delimitation of Parliamentary and Assembly Constituencies Order was issued in 2008.

Since the delimitation has been completed and the Delimitation Commission has become inappropriate, the respondents are not competent to carry out the exercise now.

The 29th Amendment to the Jammu and Kashmir Constitution in 2002 has frozen the delimitation process in J&K till after 2026. The petition contends that even when Article 170 of the Constitution of India indicates that next delineation exercise is to be carried out only after 2026, enforcing the delimitation process in UT of J&K is not only arbitrary but also violative of the basic structure of the Constitution.

The petition also submitted that on 03.08.2021 in reply to Lok Sabha Unstarred Question No. 2468 – “The question was in respect of the provision in the AP Reorganisation Act, 2014, to increase the number of seats in the Telangana and Andhra Pradesh Assemblies”, the Minister of State in the Ministry of Home Affairs said “As per Article 170(3) of the Constitution, the total number of seats in the Assembly of each State will be readjusted after the first Census is published post the year 2026 “.

The plea also challenged the increase in number of seats from 107 to 114 (including 24 seats in Pakistan Occupied Kashmir) in the UT of Jammu and Kashmir to be ultra vires Articles 81, 82, 170, 330 and 332 of the Constitution and Section 63 of the Jammu and Kashmir Reorganisation Act, 2019.

It was emphasised that the change not being proportionate with the respective population was also violative of Section 39 of the UT Act.

As per the Guidelines and Methodology for the Delimitation of Assembly and Parliamentary Constituencies issued on 2004, the total number of existing seats in the Legislative Assemblies of all States, including UT of NCR and Pondicherry was fixed based on the 1971 census which was to remain unaltered till the first census to be taken after the year 2026.

After the abrogation of Article 370, on 06.03.2020, the Union Government, Ministry of Law and Justice in exercise of power under Section 3 of the Delimitation Act, 2002, issued a notification for delimitation of Assembly and Parliamentary constituencies in the UT of J&K and States of Assam, Arunachal Pradesh, Manipur and Nagaland. By notification dated 03.03.2021, the 2020 notification was amended – Delimitation Commission was extended for another year and States of Assam, Arunachal Pradesh, Manipur and Nagaland were taken out of the purview of the said notification.

On 21.02.2022, by way of another notification the term of the Delimitation Commission was further extended by 2 months, beyond 06.03.2022.

Jammu: In a horrific accident a toddler and her maternal grandmother killed in a road accident in Kotli Mian Fateh village of Miran Sahib, Jammu, yesterday.

As per report, the accident took place when a toddler went out of her home after her grandmother who went to buy vegetables outside then a speeding tractor came and crushed to death both the victims on Bishnah- Miran Sahib road.

The deceased have been identified as Nirbhaya (2) and Neelam Devi (70) both residents of Kotli Mian Fateh village, Miran Sahib, Jammu.

“A tractor carrying a safety tank was coming and my mother was also coming from the other side of the road because she went to buy vegetables, the driver hit both my mother and granddaughter and killed them”, Victim Neelam Devi’s son allegedly said.

“My mother was trying to lift her granddaughter in order to take her away from the road,but in the meantime the tractor ran over them”, he added.

“I was in the fields looking after our cattle and when I came back I saw a crowd of people gathered on the road, then I saw my wife and granddaughter lying lifeless there”, Victim’s husband allegedly said while crying.

“What to do now as I have lost both my wife and granddaughter”, he added while sobbing.

“The police has taken the bodies to Nawanshahr”, he said.

The police has apprehended the driver of the tractor and they are probing this matter.

Jammu: Police today claimed to have arrested several stunt bikers and seized their two wheelers in Kathua district.

The police had laid nakas at several places when they intercepted several stunt bikers who were doing stunts putting lives of the people at risk.

The police immediately swung into action and seized the bikes and arrested the stunt bikers for violating the norms.

Such incidents of stunt biking and violation of norms have also been reported in Sidhra bypass area. Recently, a video of assault also went viral on social media.

Pertinently, the police in Sidhra and Nagrota had also taken action against the stunt bikers for violating the norms.

 The minimum temperatures recorded a plunge in Kashmir Valley with Srinagar recording minus 4.0°C on Monday.

It has been reported that there was a drop of 3.4°C against the previous night’s minus 0.6°C  in Srinagar. Today’s minimum temperature, he said, was below normal by 0.8°C for the summer capital.

Qazigund, he said, recorded a low of minus 4.6°C against minus 1.5°C on the previous night and it was 3.6°C below normal for the gateway town of Kashmir.

Pahalgam, he said, recorded a low of minus 10.0°C against minus 4.0°C on the previous night and it was 5.0°C above normal for the famous tourist resort in south Kashmir’s Anantnag district.

Kokernag recorded a low of minus 4.6°C against minus 2.3°C on the previous night and it was 3.1°C below normal for the place, the officials said.

Gulmarg recorded a low of minus 11.0°C against minus 13.5°C on the previous night and it was 4.8°C below normal for the world famous skiing resort in north Kashmir’s Baramulla district, he said.

Jammu recorded a low of 3.6°C against 5.8°C on the previous night. It was 6.5°C below normal for J&K’s winter capital, he said.

Banihal, he said, recorded a low of minus 3.4°C (below normal by 2.2°C), Batote minus 1.7°C (below normal by 0.9°C), Katra 5.6°C (2.5°C below normal) and Bhadarwah minus 2.2°C (2.4°C below normal).

Regarding the forecast, he said, mainly dry weather was expected this week.

Kashmir is under the grip of a 20-day-long winter period called ‘Chillai-Khurd’.

Army trains first batch of youth to be recruited as Agniveers

Dream come true for the first group of 17 Agniveers from Banihal, Ramban district prepared by the Indian Army (Rashtriya Rifles), who successfully cleared all stages of the examination to become a soldier in the Indian Army.

The Agnipath scheme was rolled out by the Government for providing an opportunity to motivate youth who are keen to don uniform in June 2022.

A drive on awareness for Agnipath Scheme was carried out by Indian Army which motivated youth from remote areas in the hilly region of Ramban district and the interested youth were given proper-recruitment training, pre-medical examinations and coaching for written exams in Banihal for six months.

Ultimately, with its perseverance and continued effort, 17 youth qualified the recruitment process to become part of the elite force.

Today Army felicitated all the qualified Agniveers and guided them on their future itinerary to become professional soldiers.

The event was attended families of all the successful candidates and others.

Jammu: A woman thief has been caught red-handed by locals in a market at Nai Basti, Gandhi Nagar, after she stole a purse from a woman shopper on Sunday afternoon.

The report said that the incident took place when a woman thief allegedly sneaked behind a woman and severed her cloth bag and stole her purse from it.

“A woman customer was shopping here, then this thief sneaked behind her & cut her bag & took out her purse” a local man who was present at the occasion of theft said.

“I was holding my bag, she severed it & stole my purse” the victim woman whose purse was stolen told media.

“I have cash inside it and it is still in the purse”, she said.

“As I put my hand inside the bag, I felt my purse missing, someone told me to go to that place where my purse went missing, then the thief got caught. They were three of them” she added.

“These burglars run a gang here, they have aides with them. We have seen 5-10 theft cases earlier in this market also.” a local said.

“This video should be made viral and everyone should know about these robbers”, another local man who was present among the crowd said.

“We will take her to police station”, a Police officer  present on the crime scene said.

“The woman customer had no idea that her cloth bag is cut and purse has been stolen” a local said.

“The CCTV cameras installed here can’t walk behind these thieves as they’re fixed at one place, but she should be arrested and strict action should be taken against her” one of the eye-witness said.

Banks will be shut for 12 days in March 2023 including the second and fourth Saturdays and Sundays as per the Reserve Bank of India (RBI) guidelines.

Termites eat up notes worth ₹2.15 lakh kept in bank locker, pic goes viral

The customers of Kalaji Goraji branch of Punjab National Bank in Udaipur lost 2.15 lakh cash after termites ate up the currency notes kept in the bank locker.

According to reports, customer Sunita Mehta had reportedly kept the cash bundles in locker number 265 which was infested with termites. The account holder came to know about this when she reached home and opened the packet. Four bundles of Rs 500 currency notes were partially destroyed while other currency notes of smaller denominations amounting to Rs 15,000 were destroyed completely.

Shocked by the incident, Mehta later raised a complaint with the bank manager and demanded the money back. She demanded that the bank refund the money which she lost due to the termites. The bank refunded 15,000 in cash to the customer instantly.

After the report, several customers reached the bank branch office on Friday and created ruckus. They questioned the branch manager over safety of their belongings. While the bank has taken cognizance of the customer’s complaint, the incident has raised questions about the safety of people’s money in the bank lockers.

Viral Video: DSP ‘forces’ lady cops to give him massage, wash his clothes

In a shocking incident reported from Bihar capital Patna, seven police personnel including four lady policemen have accused a DSP level officer of forcing them to give him massage and wash his clothes.

The complaint has been made to Patna’s Senior Superintendent of Police (SSP) alleging that Manish Kumar, Sub-Divisional Police Officer (SDPO) of Phulwari Sharif, forces them to give him massages and wash his clothes at his personal residence.

The policemen also alleges that the SDPO beats them up and threatens them with suspension if they refuse.

In a similar incident in April last year, a sub-inspector in Saharsa district was caught on camera getting massage from the mother of a rape accused. The video of the incident went viral and the officer was suspended.
The officer in question was identified as Shashi Bhushan Sinha, who was posted at Darhar outpost under Nauhatta police station area.
The video clip showed the officer talking to someone believed to be a lawyer. The cop also requested the person to help the woman as she was poor. He also said he would spend Rs 10,000 from his own pocket for the bail of the accused.

J-K’s delimitation: SC to deliver verdict tomorrow

The Supreme Court will deliver its judgment tomorrow on a plea challenging delimitation of assembly and parliamentary constituencies in Jammu and Kashmir Union Territory.

The Apex Court will pronounce its judgment on Monday (February 13) on the petition filed by two Srinagar residents-Haji Abdul Gani Khan and Muhammad Ayub Matto.

On March 6, 2020, Union Ministry of Law and Justice (Legislative Department) had issued a notification in exercise of power under Section 3 of the Delimitation Act, 2002, constituting a Delimitation Commission, with former Supreme Court judge (Retd) Ranjana Prakash Desai as the chairperson.

The exercise was completed on May 5, 2022 when the delimitation panel unveiled its final order.

The petitioners have contended that the Article 170 of the Constitution of India indicates that next delineation exercise is to be carried out only after 2026, enforcing the delimitation process in UT of J-K is not only arbitrary but also violative of the basic structure of the Constitution.
