New Delhi: A Special NIA Court at Patiala House on Thursday granted permission to Baramulla MP Er Rashid, to attend the Winter Session of Parliament beginning December 1, while remaining in custody.
Sheikh, who is currently lodged in jail in connection with a case investigated by the National Investigation Agency, had approached the court seeking interim bail or custody parole to fulfil his parliamentary duties. Additional Sessions Judge Prashant Sharma allowed his request, reiterating the earlier condition under which such custody parole could be granted.
Advocates Vikhyat Oberoi and Nishita Gupta, appearing for the MP, submitted that they had no objection to custody parole, noting that the question of travel-related expenses is still before the Delhi High Court. The NIA, for its part, told the court it did not oppose the MP’s attendance at the session so long as he remained under escort.
Sheikh’s plea regarding modification of the cost imposed for his escorted travel is awaiting adjudication by a single-judge bench, after a division bench of the High Court delivered a split verdict on November 7.
The Baramulla MP will now be able to participate in the Winter Session proceedings under the supervision of security agencies, subject to compliance with all conditions laid down by the court.
